The judge said that because the singer had “put her modern sexuality squarely, and profitably, before the public eye”, the article was unlikely to be considered defamatory. The magazine report claimed that the couple watched the video with lawyers after a member of their entourage threatened to release the footage. Ms Spears’ legal team argued that was libellous because it “maliciously and recklessly portrays [Ms Spears] as acting ‘goofy’ while watching the video with the lawyers”. But Judge Cole said Ms Spears had not brought the libel action for being “falsely accused of acting goofy”. “The issue is whether it is defamatory to state that a husband and wife taped themselves engaging in consensual sex,” she said.

Heard the rumors too. The guy apparently filmed it secretly. He’s from Hawaii. I say who cares. I like porn just as much as the next guy. But after all of the “celebrity” sex tapes that I’ve seen I could care less. Once again, unless Britney signs off a model release and provides 2257 documentation, it can’t be easily used commercially. That she was apparently drunk and passed on somewhere on the tape would also suggest that she wasn’t in condition to consent to filming (to fill the model release) and understand what it meant.
Major ass lawsuit, and not very much upside on this one. Load it up on your chinese tube sites and call it even.

Do you really need a model release to use the content? Do you need to give consent? I don’t think so. The contenet is always owned by the photographer because the photographer created the photo - not the people in it.
I don’t think i’d want to see a video of her unless it was age 18. Shes has been cute for the last 4 years without photoshop or make up.
